Barmaid caught on camera having sex with boyfriend in Domino's is to be questioned by police while HE escapes any action
A barmaid who had sex with her boyfriend in Domino's because they were 'bored' waiting for their food faces a police interview - but not her lover.
Daniella Hirst, 28, and Craig Smith, 31, were caught on CCTV at the takeaway in Scarborough, North Yorkshire while staff prepared their Pepperoni stuffed crust pizza and a side of chicken kickers.
Miss Hirst was ordered to visit the local police station over the incident because she was part-naked from the waist down.
But Mr Smith, a Leeds United fan and builder, has been told he will not face any action because he did not appear naked on camera.
Even his girlfriend is shocked by the inaction by police because 'he was the one who pulled my trousers and knickers down'.
She told The Sun: 'They said they had to investigate a public indecency offence because my a*** was on show in the video.
'Never mind the fact me and Craig had sex up against the counter'.
A North Yorkshire Police spokesman said that she was due to attend an interview but failed to show.

After the video surfaced last month Daniella told friends of Facebook: 'If your trying to tell me ya av never got a bit frisky in a random or public place then ya f****** boring haha.'
But the couple could soon change their views on public sex after police confirmed they are now investigating them for an offence of outraging public decency.
'Everyone's been ringing us thinking we would be mortified we both just laughed worse things happening in the world than him getting b***n off in Domino's hahaha.'
But last week North Yorkshire police spokeswoman said: 'Having been made aware of video footage of a sex act between two people, taking place inside the public area of a pizza takeaway in Scarborough, police are investigating an offence of outraging public decency.
'The investigation is in the early stages and no arrests have been made at this time.'
Any person who carries out an act of obscene nature in the public can be charged with this offence. Conviction carries a maximum sentence of six months in prison or a fine.

The 30 second clip showed Craig, a builder, gyrating on Daniella up against the counter as staff prepare their stuffed crust pizza at the fast-food outlet in Scarborough, North Yorkshire.
The man, wearing Leeds' home football jersey, hid behind the counter with his female companion and held onto the takeaway bar for stability during the incident.
The video was shared on Twitter after it was captured following Leeds United's 1-0 win over Yorkshire rivals Sheffield Wednesday.
The couple said it is not the first time they have had sex in an unusual place.
'Our top five include a bus, a van, a hotel, swimming pool and a field,' Craig told The Sun. 'We wanted to see if we could top it.
'We got a bit frisky and one thing led to another. Domino’s is definitely now our number one – going to be hard to top it.'
The couple from Bridlington, North Yorkshire, had travelled to Scarborough for a night of drinking when they got peckish and headed for a pizza.
They said they never expected their risky escapades to end up online.
'Everybody we know has had sex in risky places,' said Daniella. 'It’s just one of them things that people do.
'Unfortunately for us it ended up on the internet. We’re open minded. We won’t do it in Dominos again. Maybe Pizza Hut.'
